TERMS: To established accounts 30 days net. If you wish to become an established account please furnish trade and commercial references and allow time to investigate. Telephone and fax orders must be confirmed by mail to be accepted, except from established accounts. Overdue accounts subject to two (2) percent per month service charge, plus cost of collection, if any. This is an annual percentage rate of twenty-four (24) percent.

    This list cancels all previous lists. Prices are for 2007-2008 and are subject to change without notice.

    CONDITIONS OF SALE: All quotations in this list or any special quotations are made subject to market changes, supply being exhausted, or shortage beyond our control and we reserve the right to reject all or any part of your order, refunding payments made. Prices are F.O.B. our shipping point.

    Every effort will be made to supply true-to-name stock and we will replace upon proper proof anything that may prove otherwise. but it is mutually agreed that we will not be responsible for more than original purchase price.

    NO CLAIMS OR ERRORS, SHORTAGES, ETC., WILL BE CONSIDERED UNLESS MADE SPECIFICALLY BY WRITTEN NOTICE WITHIN TEN DAYS FROM DATE YOU RECEIVE THE SHIPMENT. Stock damage in transit by delays, neglect of carrier, or any other cause beyond our jurisdiction is your risk and adjustments must be made with the carriers. Our assistance in any way to establish such claims will be gladly given.

    When shipping instructions do not accompany your order, we will use our best judgement, assuming no responsibility.

    A certificate of inspection will accompany each and every shipment.

    Buyers represent and agree that any dispute arising from the sale of goods shall be arbitrated exclusively in the Chancery Court for Warren County, Tennessee; and the State of Tennessee shall be the forum for any and all litigation that may arise from any sale of goods by the seller. Either party not prevailing in such action shall be liable to the prevailing party for reasonable attorney fees.
